Gross Misconduct - Notice Of Disciplinary Meeting

Gross Misconduct is misconduct serious enough to overturn the contract between the employer and the employee thus justifying summary dismissal. It is up to the employer to reasonably determine what acts amount to gross misconduct. A non-exhaustive list of offences that the Company will normally regard as gross misconduct is included in the Disciplinary Procedures and Policy which provides the company's complete policy on disciplinary procedures.

If an employee commits an act of gross misconduct, the Company is entitled to summarily terminate the employee’s contract of employment without notice or payment in lieu of notice. 

When Should this Gross Misconduct Disciplinary Meeting Notice be Used?

This notice should be used following an investigation into the alleged gross misconduct. The investigation must be reasonable and fair, and carried out before any decision has been made in respect of dismissal. It is imperative that a fair and reasonable procedure is followed throughout the disciplinary procedure. 

During the investigation the employer may choose to suspend the employee in which case please download the Gross Misconduct Suspension Letter. Notes to the investigation, relevant documents and evidence should be kept. Once the investigation is completed and and indicates gross misconduct the employer would then apply this notice.

What are the Key Details of the Gross Misconduct Disciplinary Meeting Notice?

The Gross Misconduct Disciplinary Meeting Notice satisfies “ACAS Code of Practice” principles for disciplinary procedures.

It is a formal, neutral letter avoiding prejudgement of guilt:
- Provides written notice of the allegations which must be described clearly with supporting documentation enclosed.
- Details time and location of the meeting, and attendees.
- States employee will have opportunity to respond.
- Confirms entitlement of the employee to be accompanied.
- Warns that dismissal is a possible outcome but no decision will be made until after the meeting.
- Allows employee to request alternative date and reasonable adjustments.
- Provides for details of contact for questions.
- Includes an optional clause confirming whether the employee remains on suspension pending the meeting.
