New Information for Setting Up and Running a Charity

These New Charity Law Information Pages are a valuable resource for charities and their trustees both when setting up a new charity and running a charity on a day to day basis. They contain links to template documents and other information relevant to all types and sizes of charity organization.

The information covers the following areas: 

Charities Act 2022 . This outlines various changes and reforms made to charity law by the Charities Act 2022 and indicates when each of the changes were brought into effect.

Setting up a new charity. This covers most of the issues that need to be addressed by those looking to found a new charity before they take any steps to set up their intended new charity (including whether a Community Amateur Sports Club (“CASC”), Members Club or some other type of organization should be set up instead). It also includes links to information and document templates that you will need to use when you are actually setting up your new charity. 

Charity trustees. These pages deal with a range of issues relating to trustees including explaining who can be a trustee, their role, duties, liabilities, and other topics.

Charity volunteers. This covers a wide range of topics relating to volunteering with a charity, including the nature of the volunteer role, policies and procedures, duties, trustees as a type of volunteer, liability, insurance, health & safety, volunteer expenses, volunteer fundraising, data protection and intellectual property. 

Charity fundraising. This deals with all of the usual methods of fundraising, including donations of cash and goods, appeals, legacies of cash or property, grant agreements and grantmaking policy, lotteries and raffles, sponsorship, engaging commercial entities to raise funds, and fundraising by volunteers. It also outlines regulation of fundraising by charities. 

Charity contracts/commercial arrangements. This considers aspects of contracts/agreements entered into by charities, including suitable terms of contract for buying or selling goods or services, for fundraising agreements, and for lease, rental or hire of premises. It also signposts guidance and documents dealing with standard contract clauses, MOUs, letters of intent, negotiation of contracts, employment, events and hospitality, website Ts and Cs, IP, data protection, and other topics of relevance to a charity. 

Charity trustees will find the information on these topics helpful not only when setting up a new charity but also when running their charity day to day and planning for the future.
