Summary of Tenant’s Rights and Obligations (Variable Service Charge)

PROP.RES.291

This Summary of Tenant’s Rights and Obligations (Variable Service Charge) should accompany the Service Charge Demand for Residential Property when a landlord is serving a leaseholder tenant with a demand for service charge payment.

Why Do I Need To Serve This Document

Under section 21B of the Landlord and Tenant Act 1985, as amended by the Commonhold and Leasehold Reform Act 2002, a landlord must include a Summary of Rights and Obligations when demanding variable service charges.

The Summary Of Rights and Obligations

The Service Charges (Summary of Rights and Obligations, and Transitional Provision) (England) Regulations 2007 provide the exact wording and format of the summary of their rights and obligations when serving a service charge demand. The summary of rights and obligations must accompany a demand for payment of a service charge.

Additional Obligations

Under section 47 of the Landlord and Tenant Act 1987, the landlords name and address must be specified on the demand, it must be the landlords actual address, and not that of an agent.

Under Section 48 of the Landlord and Tenant Act 1987, the landlord must provide an address in England and Wales at which notices may be served on him by the leaseholder.

Summary of Tenant’s Rights and Obligations (Variable Service Charge) is part of Property. Just £38.50 + VAT provides unlimited downloads from Property for 1 year.
