Right to Rent Checks and Staying Compliant

How To Conduct A Right To Rent Check

You must conduct right to rent checks on all prospective adult occupiers. These checks can be performed in the following ways:

  • a manual right to rent check;
  • a right to rent check using an Identity Service Provider (IDSP) and Identity Document Validation Technology;
  • a Home Office online right to rent check; and
  • in certain situations, a check may be required with the Home Office Landlord Checking Service

Landlords and Lettings Agents can use the Checklist for Right to Rent Immigration Checks when undertaking manual checks.

What Happens If My Tenant Does Not Have A Right To Rent?

Landlords cannot let their properties to adult occupiers who do not have a right to rent, as soon as a landlord becomes aware of a tenant not having a right to rent they must immediately inform the Home Office and issue an Eviction Notice for Tenant with No Right to Rent to avoid a civil penalty.
