This Notice of Grounds of Possession by Landlord or Mortgage Lender sets out the statutory grounds ( Ground 1 and Ground 2 in Schedule 2 of the Housing Act 1988), on which a landlord may recover possession of a property. 

This notice must be served before a tenancy is entered into, and mortgage lenders often require it as a condition of the mortgage. 

What is a Notice of Grounds for Possession?

It is a formal notice given to tenants at the start of the tenancy. The document makes clear that the landlord (or in some cases, the mortgage lender) may rely on legal grounds to take back possession of the property in the future. 

When can a landlord use Ground 1?

Ground 1 allows the landlord to repossess the property if the landlord previously lived in the property a their main home, or the landlord (or their spouse) wishes to move into the property as their main residence and was the owner of the property prior to the tenant moving in. 

When can Ground 2 be used?

This ground relates to a lenders right to possession. If the property is subject to a mortgage, the landlord must notify  tenants that the lender may rely on this ground to obtain possession  for the reason stated in the ground. 

This Notice of Grounds for Possession should be countersigned by the tenant. This confirms that the tenant has received and accepted the terms of the notice, reducing disputes if possession is later sought by the landlord or lender.
